UPDATE: Jenny Gallagher’s untimely death is getting stranger by the moment.
Judge ruled that defense does not have the right to have an expert observe testing materials in evidence. They claim testing will alter or even damage the evidence and they need to be present when the testing is done in order to verify accuracy. Judge ruled against them.
Holmes was recently evicted from his apartment. His remaining clothes and a bed were removed by the public defender’s office.
Of the 4.4 million dollars of donations already collected to help the victims of the Aurora Massacre, only a paltry $100,000 has been released to the actual victims. The not-for-profit set up to handle all the cash is making a big deal about releasing another $350,000 but according to my math, that leaves 4 million or so sitting in their accounts doing nothing. The judge has released the contact information of the victims to the charity so they can hand out the 350,000. Guess the 4 million is administrative fees…
New documents in the trial show that the cops in Aurora are worried about Holmes’ safety. Do we have another Jack Ruby moment in the near future?
Corbin Dates, the witness who claims to have seen someone receive a phone call and get up to open the emergency exit in the back of the theater apparently told one of Chris Mathews’ producers that the guy he saw had a goatee. When asked about that, he seems to confirm it live on Hardball. That story dropped down the memory hole pretty fast.

Early in the investigation, some MSM outlets seemed at least willing in indulge in some honest speculation raising questions about the case such as “who called him” “did he act alone” and “why would he set the traps up just to warn the cops before they were sprung”. There are many other questions but at least this was a start. It was also then end. No more uncomfortable questions seem to be coming from the complicit media about this case.

UPDATE: Chris P found this video where a newscaster reads off the list of what police found in James Holmes’ apartment. Included in that list is his cell phone. According to the official account of the story, the guy inside the theater (with the goatee) supposedly received a phone call and went outside the exit door while talking on his cell phone. If that was Holmes, then who’s phone did he have? Or was that not Holmes?

I maintain that Dateline is putting words in Corbin Dates’ mouth to spin the story. Dates only ever mentions a “goatee” in his interviews and that there were two men. If he really thought that the beard was fake and the “man was back,” he wouldn’t have responded like he did in this interview with Chris Matthews:

I would point out that Corbin Dates himself didn’t say he “saw someone in a fake-looking red beard”. It was the newscaster. And they’re putting a LOT of words in peoples’ mouths with this case.

I distinctly remember this nurse being interviewed by the news here in Denver a day or two after the shootings, she seemed rather traumatized and I remember her saying she’s never been in a war, but imagined that was what she would see. I’ll see if I can find the clip from CBS4. I hope this just a bad coincidence but I dont believe anything anymore.

I saw an article saying they were worried about his safety. My suspicious eyebrow thinks that may be a precursor of what is to come. I keep up with this case, but every new update makes less sense than the preceding ones. It’s like a bunch of pieces from different puzzles, they don’t fit.

There’s a link I’m trying to post (hope I didn’t post duplicates) where this witness, who was a neighbour of James Holmes, saying that the guy that was with Holmes hours before the attack was a “White Stocky male”. This person and JH were apparently running from the theatre back to Holmes’ apartment.
There is another video I saw (I figure has been taken down already. Go figure) where these two witnesses who lived either in the same apartments as JH or across from them, mentioning how there were vans, also unmarked police vehicles, outside of the apartments and were there for days scoping out the apartment. And they said prior to the attack/massacre there was always some weird guy hanging out in front of JH’s apartment.

I do remember a neighbor saying JH was talking to some guy outside in the back who was trying to hide his face (and again, neighbor had no mention of JH having red hair; and this was hours before) but not that they are running back from theatre? I didn’t think it was that close, or how you could tell that was where they were coming from?

The video you are referencing of the neighbor is impossible to post here for some reason. You can find it by searching Youtube for the video called, “Colorado theater shooter, not a lone gunmen?” [sic].
The neighbor doesn’t describe him running from the theater, though (which was three miles away)–only on a nearby street around 7 p.m. with a stocky man with dark hair and a green shirt. I personally think this guy may have been the drug-er or handler. (It sounds like the neighbor says they’re running from 17th street toward the apartment, but 17th street is too far away, so I’m a bit confused by what she is trying to say.)
Wish we could find the second video you describe that mentioned vans and a weird man hanging out near JH’s apartment.
This is a re-post but seems relevant here. These are some neighbors who are essentially told to shut up, go inside and watch the news by officers first on the scene at the apartment of Holmes.
Sounds like 3 or so hours later they were evacuated, why the late evacuation only when the media showed up?

This is interesting for the following reason: Holmes’ cell phone was found in his apartment. The man reported in the “official” story to be Holmes got up & exited the theater and had a cell phone AND a goatee–neither of which Holmes possessed
Although it’s not impossible that a broke college student would possess multiple phones, or that he would shave a goatee off before committing a crime, it seems unlikely that Holmes could not possibly have been the guy who appeared to answer his phone and to leave the theater door cracked for later re-entry.
The theater exit doors did not open from the outside, so the shooter–whoever he was–could not have expected to enter from the outside without an accomplice to let him in: the man with the cell phone & goatee.

This is a Dateline piece on the shooting. First time I am noticing the Gas Mask by the rear right tire of the white car(about 4 min mark in the video, and some pretty good footage of the white car, seemingly early in the investigation) Is that the “non-regulation mask” or is the other mask down the block non reg?
And if the mask down on the corner is regulation could it have been dropped there by police, like assume the giant police shield was, and marked as evidence?
Anyone know if items police may have set down or dropped would be marked as evidence by the FBI?
I actually did notice that there looked like a 4th gas mask by the right tire from the pictures. But figured since the 3rd one was already being ignored there wasn’t much sense in bringing a possible fourth up too.
@ 0:30 narrator states that it was a shooting scene when he came in–I’m pretty sure most witnesses are saying it was a dramatic scene and not a shoot out scene, the shoot out scene was in Theater 8 at that time. To my recollection Cat-woman was robbing Bruce Wayne.

Yep, these two witnesses also say it was a slow scene when the shooting started. In theater 8 though it might’ve been a shooting scene:

Confirmed. Movie was on a slow/serious part in theater 9, shooting part in theater 8. This is a witness from theater 8.
And why is the animation of the shooter coming in from the left? I haven’t even made it 40 secs in and there seem to be glaring inaccuracies.

I haven’t followed the Sikh shooting very closely but I thought this video did a good job of breaking it down.

If the white car is Holmes’ car and the plates led to a different Aurora address (not the infamous booby trapped location), wouldn’t they send bomb squad and swat etc over there to check for bombs for the address associated with the car?

The car is in fact his. I google earthed his San Diego address and his car is literally parked on the side of the street. Perhaps he moved?
I did see an article saying he had planned to move down the block, and people were reasoning because he was no longer a student he had to move out of the booby trapped apartment, so he was mostly looking at places close by.
At 12:51 (0051), An officer reports “that [the] suspect [is] saying he’s the only one but I’m getting conflicting descriptions from the witnesses here.”
Oates never mentioned that.
-So apparently James Holmes said something to the effect of I’m the only one.
-The officer mentions the conflicting descriptions of multiple shooters with a lot of conviction. To me his delivery has the tone that he thinks that is a high probability.
This is from an officer who had taken statements from witnesses. This was long enough after it happened that it’s hard to claim “chaos and confusion” as the cause for this report.

I am surprised Oates wouldn’t say to the media that the suspect said three things: I am the joker, I have bombs in my apartment and I am the only shooter.

3) Officer testimony of Holmes “admissions”.

Course now after so long and other interesting things happening, to witnesses and such, there is no telling what they would say if asked.
That is the oldest line in the book. I’m the only one, there was nobody else.And yet Oates is taking the word of an alleged mass murderer that there was nobody else helping or shooting? Would they do that if it was a bank robbery and the witnesses said there was more than one robber?

The media misquoted his mother…. and you know, it is possible Holmes was saying that he was the only one in the car!
This report is untrue and is one of many accounts that has been refuted in other threads. The only witness who claims that Holmes shouted and grabbed people, only to shoot them at virtually point-blank range, is Stephanie of the “Allie and Stephanie” story that was floated to account for the copious amounts of blood lost in the trail behind the theater. I’m not saying that Allie wasn’t shot, but all other theater 9 witnesses that have come forward claim that the shooter was silent, calm, detached.
And, when you think about it, it makes sense: as many can attest, it’s very difficult to even see in a gas mask, let alone in a dark smoky theater, let alone shout commands at people while wearing said mask, let alone grab people and hold them presumably at arms length so you can shoot them with your long gun, while at the same time toting other weapons and maintaining a staggering 50% hit rate (as reported in the media) and hitting 70 people, all within 90 seconds, which includes time to reload and to step outside and run along the back of the theater. Not buying it, lone media report.

This is the second witness I’ve heard of who says that he’s surprised to see Holmes is some scrawny guy b/c the shooter appeared much larger. Not saying that body armor can’t make a person look bigger, but how much bigger can it make a lanky 150 lb., 5′ 11″ guy look, I wonder?

The 6′ 3″ came from the FBI. Holmes (albeit dubious) match.com profiles list his height as 5’11″. The booking report and warrant list his height as 5’11″.

Not sure, but upon close inspection, they are not specifically footprints but more like blood spurts that came from a wound (maybe arterial leg wound?) as someone moved around back and apparently got picked up where the blood trail ends. I suppose the blood could have come from someone’s torso if he/she were being carried. Doubtful that it came from victim Allie’s grazed neck, however; the blood loss alone suggests to me that the victim probably didn’t fare too well.

It seems Corbin Dates has been convinced James Holmes is guilty until proven innocent as well now. Unfortunately he wasn’t asked if this was the man he saw take the cell phone call.
That’s interesting. Why did Corbin act like he was surprised to see his face for the “first time”? Didn’t he see his face and bright orange hair in the theater? Maybe the bright orange hair could end up being JH saving grace, since no one saw bright orange hair in the theater. I just don’t understand that.

Not even change around, just outright put words in his mouth. He probably said goatee like in the Hardball interview. The media, obviously wanting to frame Holmes from the beginning, quickly edited this out and changed it to a “fake-looking red beard” since that’s the only thing that could fit with the official story.
I think he still feels that the person who opened the door was someone else. He probably thinks that this was indeed the first time he saw the shooter without all the equipment.
As soon as I saw this I was wondering “What the **** is Kyung Lah doing covering this?”
The woman was posted as CNN’s Tokyo corrspondent for the past 5 years – despite the fact she didn’t speak Japanese and was a Korean-American who was fervently pro-Korean and anti-Japanese. Her stories consistently portrayed Japan in the worst possible light. Finally, to much happiness among Japanese netizens, she was finally reposted to LA at the end of June this year. Not sure why the hell they have her travelling all the way to Colorado to cover this but she is incredibly sketchy and her journalistic integrity is non-existant.
Corbin has NEVER, on his own accord, described the guy taking the phone call as having orange hair. To me, if I saw that guy, that’d be the first thing I’d mention. I think it’s pretty safe to say that because he has never once stated it in an interview, the person we all saw in that courtroom is not the person Corbin saw taking the call. I, too, wonder why the media has never outright asked him this question, but I think the fact that they haven’t, says it all.
It’s just common sense and logic.

You really have to wonder how much they can control media at the local level. Reality Check with Ben Swann said that their segment on the shooting was part 1 of a 2 part investigation. Then there never was a 2nd part. And that’s at a FOX affiliate that is employee owned rather than corporately owned.

I wish I knew how to post a picture, but that 4min mark on the dateline special is amazing to me. I can see a pair of running shoes in the back of his car, the gas mask near the tire with like yellow cylinder or maybe reflective metal near the mouth piece, like 4 other items I can’t make out.

Not sure if this is new info or not but is License plate reads 119 – ROC and has like mountain landscape image, with pinkish registration stickers.
I think his running shoes might be asics but it is bit to blurry to tell.

First one doesn’t even look like a gas mask to me, it is quite blurry. The one on the corner I have scene a lot of but I think that was just a police officer who had to drop it for some reason. The one by his car tire has me very interested.
The police don’t tag their own gear, for crying out loud.
And they don’t drop their gear… it takes a brief several seconds to hang a mask on their belt.

Technically it would go in as evidence, just like the police shield. But it’s still highly unlikely that they’d leave it at the crime scene.

I don’t remember any witnesses saying that the shooter was wearing a big back pack. It sounded to me like the difference in the mask was more subtle, perhaps like the yellowish bit on the mask near the back right tire.
I think that yellow is an evidence marker.
Yellowish bit? It’s probably an evidence tag. That’s clearly some sort of mask attached to that backpack looking thing.
I don’t think that is hose. Look at the bottom right view. You can see that what looks like a hose, is some sort of circular formation, likely on the ground surface.

The one by the rear tire of the car is another one I’d like find a better version of also. Regarding that one, I believe they yellow looking bit is actually on the filter assembly. If you search those online, it looks like some filter cans have that yellow or orange label on them.
I read awhile back, where someone said that there were blood smears and streaks on that grey van near the gas mask marked as evidence #1. Anyone have better pics of that grey van?

I think they start on the corner near the front then walk all the way down to where the most visible gas mask was.
All that gear that the police are examining and tagging… who was wearing that? Because now they claim that Holmes was sitting in the car with his gear on…. and they took him to jail with it on…… and that chest protection piece up near the exit entrance…. tagged with a number… who wore that?
Does protective gear come in sizes? Could they tell if the gear was the correct size for Holmes? Could he possibly have worn all of that stuff? and still walked?

At 0227, an officer calls for a bomb unit to search the suspect’s car, adding “pay special attention to the charcoal hatchback,” a reference to the charcoal colored Hyundai Accent bearing Tennessee plates.
I heard the green pants mentioned quite a few times and find that strange seeing as the shooter was in all black.

False alarm on the Hyundai Accent it seems, yes. James Holmes’ car definitely had CO plates so it’s not referencing that.
The very first description of the shooter is a white and blue plaid shirt. Maybe wearing green camo pants?

It seems Holmes is being kept on drugs. Probably can’t legally force him to take them, but doesn’t mean they can’t coerce him to. It’s possible the CIA gave him something crazy we’ve never heard of, though. Either way he isn’t in his right mind currently, and I believe he probably doesn’t even know whether or not he carried out the shooting.
Media is beating that drum that Holmes has no sympathy for the victims, has an evil scowl on his face and you know….uhh has scary crazy red hair.

Ironically I think Holmes should be wearing something like swat gear protection in the trial. I could see relatives of victims very upset that he might get the insanity verdict.
The did the same thing to McVeigh hoping he would get shot.
The media has framed Holmes from the start. Ever since they misquoted his mom saying, “You have the right person” when she was only referring to herself. It’s not like that was a misunderstanding. That was deliberate and malicious.
I pointed out earlier that if he was wearing the gas mask in the car (something very unlikely for somebody to do normally), that a gas mask also makes a good device to not only filter out things in the air, but as well administer substances. Like ether for example, which can not only cause a subject to pass out, but can cause damage too, or even death.
I just had a thought. What if the police actually saved Holmes without even knowing it? Maybe the other suspect left Holmes in the car with a gasmask and a drug to make him OD and die and therefore leaving no traces, but since Holmes was apprehended before dying, the police and media had to start making shit up, thus “ruining” the original plan.
and the police making shit up I mean Oates, because the ones who responded and went to the theatre were just doing their job not knowing it was staged, I think.
It will be interesting to see what else happens to the witnesses, especially the ones that have spoken to the media with their contradictory statements…should we even be worried for Corbin? Sorry to say this, but I think its valid if suspicions are correct and there really is a huge cover-up…right?
I’m taking another look at James Holmes hearing footage. Just try watching it, but imagine the guy is innocent and being set up, and forget how the media said he was acting in court. Dazed, crazy, incoherent etc. He is reacting to specific statements being said. His actions could be interpreted as acting sad, confused, and in a state of extreme disbelief, according to my analysis.
At :25 he closes his eyes to try to remember anything he can, then makes an expression of EXTREME disbelief. If he did this, the guy could win an Oscar for his performance here. The medias trying to spin it like he’s acting crazy to for an insanity defense. I’m guessing he’s more with it in these later hearings. His lawyers are advising him to remain silent, even on basic yes and no questions the judge asks.
Yeah. What I keep going back to are the close-up photographs of his eyes in which you can plainly see his pupils are enormously dilated, indicating drugging of some kind. If it weren’t for that factor, one could reasonably argue that his behavior is possibly faked. Given his pupils, however, and the fact that he looks incredibly tired and unable to focus his vision (consistent with drugging), the likelihood of his behavior being an act is slim to none.

One other thing that I would like to add- regarding the riot shield.
That riot shield is a First Choice MUST level 3a, or at least it looks like the same model to my eyes. Pretty pricey piece of gear.
I wonder if there is any way to figure out if any of those responding departments use that model?
Also, the positioning of it is kinda odd. Almost as if it were dropped by someone moving away from the back door area. Just a thought of course.

Has he actually had conversations with his own defense team, at all, about anything in anyway? Would love some info on that if someone has it.
I’m sure they’ll convince him his only hope is to plead insanity.
The new photos were interesting. I noticed that he had a still green plant, which meant he obviously had been watering it. Is that something that someone who has given up on life would do? Also, he had a nice lamp, table, and jackets. Looks like his apartment was sparsely decorated but tidy. The table with the lamp has a half-full cup of soda or something and what looks to be a sandwich box and/or wrapper. Very interesting.
Also, if you look closely in one of the pictures, it appears that a poster has peeled away from a cardboard backing. It looks like his poster was affixed to a piece of cardboard or was in a clear poster-frame to protect it. I’m sure this is insignificant, but I just find these details fascinating because they indicate someone who didn’t have any intentions of blowing up his crap, at least at the time he moved into it and hung up his posters and stuff.
I take that back–the half-full cup is actually a candle. A candle! ‘Cause every mass murder keeps a scented candle on his end table so he can still read bomb-making books in the event of a power-outage, right?!

So at 1:54ish in the video is that a fireman with a full gas mask that has a back pack unit and a white stretcher board walking toward the area where James Holmes car was?
In this video it looks like Holmes is at the least able to take orders.
At the very beginning he is asked to “please be seated” and seems to sit of his own accord. Similarly, at the end, he stands up and walks out though perhaps a bit sloppily as the guard does trip over him.
I imagine whatever he is on or has been done to him makes him highly susceptible to suggestion, but still quite vegetative.

Oates did say if it wasn’t for that one great observation from his officer about the one out of place item on the swat gear of the shooter, the shooter could have been easily mistaken for an officer on scene.
you see, that just doesn’t make any sense….. if they first spotted Holmes sitting in his car… windows up… then this remark by officer about noticing ‘difference in swat gear’ HAS to be about the second shooter…..just how many police officers , while working a threatening shooting scene, go and sit in a closed up car? So they spotted a suspect in the crowd because the suspect was wearing an item of strange swat gear….. and they noticed a man sitting in a white car that is parked right in back of exit of theater 9….they carefully approach the car and peek into the tinted windows? Didn’t they worry that the ‘man’ might shoot their heads off? They certainly didn’t take time to peer hard at every thing he was wearing.. something is so strange..

Maybe because during all the confusion, people still trying to get out of building… wounded victims, and police moving in….. that when this suspect was noticed….. and officers confronted him…. the suspect quietly showed his ID…. that of a special CIA (?) group…. and then the officers just let him go… and the ‘suspect’ took off his mask and left the scene…. (at end of building)
That left Holmes, drugged and alone.
This link it posted above as well, but I wanted to point something out….does anyone else find it odd that it looks like they pulled 3 computers out of Jame’s apartment. There is a picture of one officer carrying a desktop and then a second picture of a different officer carrying a laptop and 3rd officer carrying a 2nd desktop.
It seems odd to me that he would have three computers in his apartment. Thoughts?

I think the 2nd desktop is just a different guy carrying the same Lenovo Desktop, but not %100 sure.
If you read the caption on the photo before it, you will see that the cops were removing computers and such from neighboring apartments for the residents so they didn’t have to go into the building. Probably one of those.

Btw. I don’t know if it’s already been covered on this page, but the defense *is* allowed to have an expert present for scientific testing as to “consumptive or destructive testing.”

Last I had read, the court had granted the defense the ability to have an expert present for “destructive testing” but also denied for “non-destructive” testing.
Non-consumptive testing is from what I understand, is evidence that will not be destroyed by testing.
I’ll admit
I know jack squat about evidence, and classifications and what not. It would be nice to have someone knowledgeable in that field. Specific questions would be the protocols of tagging of evidence at a crime scene, whether left by the assumed perp or other outside parties. Also, whether outside items are destroyed or returned to service. Finally, what constitutes said evidence to undergo testing – destructive or not?
Things like ammo, firearms, gas masks all come to mind.
Would’ve been nice if they had someone present when they tested James Holmes for gunshot residue on his hands.
Destructive testing, not sure why you’d mention a gas mask there. Anything that causes a reaction that can’t be undone is probably considered destructive. DNA testing would probably be considered destructive. We’d need a defense lawyer or someone who could help with that.
Defense tried to argue that all evidence testing is destructive in some nature and will quite likely alter the evidence.
Judge said if something is totally consumed or destroyed he would let an expert for the defense be present during prosecutions testing.
Also, the defense is allowed to test any items in evidence independently. (after the prosecution has had their turn to test it, I assume).
